Under Latvian law, the owner of an online shop must specify the terms of delivery and return of goods, as well as the right of withdrawal. Such a clause is called a distance contract (CM Regulation).

1. Distance contract
The seller of the goods offered in this Online Shop, hereinafter referred to as the Seller, and the person placing the order, hereinafter referred to as the Buyer, conclude the following Agreement:
The Seller undertakes to sell and deliver to the Buyer the Goods in accordance with the Buyer's order.
2. Delivery and payment arrangements
The Buyer orders the goods through this website, specifying the type and quantity of goods to be ordered. The Buyer has the option to pay for the goods using the payment tools integrated in the Online Shop or by paying the invoice prepared by the Seller and sent to the Buyer by e-mail corresponding to the order. The invoice shall be drawn up electronically and shall be valid without signature.
Within Latvia, we recommend using OMNIVA parcel services, but outside Latvia, visit https://balticchefs.com. The Seller ensures delivery of the goods in Latvia within 3-7 working days (sending via Omniva parcel office) after receipt of payment for the goods.
The Buyer has the right to withdraw from the Goods within 14 calendar days of receipt of the Goods by sending a letter of withdrawal to the Seller. The Seller shall send the form of the cancellation letter to the Buyer by e-mail at the Buyer's request.
The Buyer is obliged to return the goods to the Seller within 7 days after sending the letter of cancellation. Any costs incurred in returning the goods to the Seller shall be borne by the Buyer.
Section 12(6) of the Consumer Rights Protection Law of the Republic of Latvia states that "the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Buyer to exercise the right of withdrawal or to withhold the refund fee in the event that the goods have been damaged by negligent handling or failure to follow the instructions during use, if the original packaging of the goods has been lost or if the packaging of the goods is substantially damaged.
If you wish to return your order, please contact us by email: [email protected], including the order number and the reason for the return. If the item was delivered with a defect, please attach a photo in the email. We will contact you further. Please note that the return shipping costs are borne by the Buyer, unless the goods were delivered to you with a defect or you have not received the goods you ordered. Once we receive your returned product, we will transfer the purchase amount to the account you have provided within 30 days.
When submitting a claim, the Buyer must enclose the VAT invoice (invoice number) for the purchase of the Goods and provide the following information:
1. Order number;
2. the defect, signs of damage or missing part of the Goods;
3. provide other evidence, such as a photograph of the Goods, a photograph of the defective area (if it is a mechanical defect and can be photographed), a photograph of the packaging of the Goods, etc.
When submitting a claim, the Buyer must specify one of the ways in which the Buyer wishes the claim to be resolved:
1. the Seller shall remedy the non-conformity of the Goods - defects - without compensation within a reasonable time if the defects can be remedied.
2. reduce the purchase price accordingly;
3. replace the Goods with analogous Goods of the same quality, unless the defects are minor or caused by the Buyer;
4. cancel the Contract and refund the amount paid by the Buyer for the Goods if the sale of Goods of substandard quality constitutes a material breach of the order.
Upon examination of the claim, a reply shall be provided within 14 (fourteen) days.
Obligations of the Buyer
1. The Buyer undertakes to provide only correct and complete information on the Purchase Form. In the event of any change in the information provided in the registration form, the Buyer is obliged to update it immediately.
2. The Customer undertakes to use the Online Shop in a fair and proper manner and not to interfere with its operation or soundness. If the Buyer fails to comply with this obligation, the Seller shall have the right to restrict, suspend (terminate) the Buyer's use of the Online Shop without prior notice and the Seller shall not be liable for any losses incurred by the Buyer in connection therewith.
3. The Buyer shall pay for and accept the Goods ordered in accordance with these Conditions.
4. Notwithstanding any obligations under any other clause of these Conditions, the Buyer undertakes to inspect the Goods before using them (including before putting them together, assembling them, etc.) and to ensure that the Goods received are those ordered by the Buyer.
5. The Buyer is obliged to comply with other requirements stipulated in these Regulations and the legislation of the Republic of Latvia.
Seller's obligations
1. use its best endeavours to ensure that the Buyer is able to make proper use of the services provided by the Online Shop;
2. respect the privacy of the Customer, process the Customer's personal data only in accordance with the Terms and Conditions, the Privacy Policy and the legislation of the Republic of Latvia.
3. The Seller undertakes to comply with all the requirements set out in these Conditions.
Data processing
By entering the necessary information and placing an order, the Buyer confirms that he/she is familiar with and agrees that the data provided by him/her shall be used to enable the Seller to accept the Buyer's order and deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees to receive notifications related to the processing of the Buyer's order to the e-mail address provided.
By entering the necessary information and placing an order, the Buyer confirms that he/she is familiar with and agrees that the data provided by him/her shall be used to enable the Seller to accept the Buyer's order and deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees to receive notifications related to the processing of the Buyer's order to the e-mail address provided.
7. Other provisions
The Buyer shall have certain rights under the laws of the Republic of Latvia in respect of Goods of substandard quality. Nothing in these Conditions shall be construed as limiting or restricting the exercise of such rights.
These Terms and the relationship between the parties under these Terms (including the formation, validity, application and termination of the Agreement) shall be governed by and construed in accordance with the laws of the Republic of Latvia.
